  1. A. Cancellation Policy

    Right of Withdrawal for Consumers

    If you order from us as a consumer, you have a statutory right of withdrawal. A consumer is any natural person who enters into a contract for private purposes, that is, not predominantly for their commercial or self-employed professional activity.

    A. Withdrawal Policy

    Right of withdrawal

    You have the right to withdraw from this contract within 14 days without giving any reason.

    For contracts for the delivery of goods, the withdrawal period is 14 days from the day on which you, or a third party other than the carrier and indicated by you, acquire physical possession of the last of the goods.

    For contracts for the supply of digital content not supplied on a tangible medium, and for contracts for the provision of services, the withdrawal period is 14 days from the day of conclusion of the contract.

    To exercise your right of withdrawal, you must inform us (Lynice Berger, Lynice Divine Magic, Luitpoldstraße 6, 86157 Augsburg, Germany, E-mail: lynicedivinemagic@gmail.com) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or e-mail). You may use the attached model withdrawal form, but it is not obligatory.

    To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

    Effects of withdrawal

    If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

    For contracts for the delivery of goods, we may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

    You shall send back the goods or hand them over to us, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.

    You will have to bear the direct cost of returning the goods.

    You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

    If you requested that the performance of a service begin during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have informed us of your withdrawal from this contract, in comparison with the full coverage of the contract.

    When the right of withdrawal does not apply or expires early

    For digital content, your right of withdrawal expires early if we have begun to supply the content after you have expressly consented to us beginning before the withdrawal period has ended. It is also required that you have acknowledged that you lose your right of withdrawal once we begin supplying the content, and that we have provided you with a confirmation of the contract containing this information on a durable medium (e.g. by e-mail).

    For services, your right of withdrawal expires once we have fully performed the service, provided we only began the service after you gave your express consent and at the same time acknowledged that you lose your right of withdrawal once the contract has been fully performed by us.

    (Only include if you offer personalised candles:) The right of withdrawal also does not apply to goods that are not prefabricated and for whose production an individual choice or specification by you is decisive, or which are clearly tailored to your personal needs, for example candles with an individual name, text or design.

    Tips for returning goods

    To make sure your item reaches us safely, please pack it well, ideally in its original packaging and with all accessories. Candles are fragile, so sturdy outer packaging helps prevent damage in transit. Please send the parcel with sufficient postage. These tips are a request and not a condition for a valid withdrawal.
